Overview
These Terms of Service ("Terms") govern your access to and use of the ClaimStation application and related services (the "Service") operated by Nations Public Adjusting, Inc.("ClaimStation," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a firm, you represent that you have authority to bind the firm.
01Eligibility#
ClaimStation is a business tool for licensed public adjusters and their authorized firm members. You must be at least 18 years old. You must hold (or be working under the license of) a public adjuster licensed in the state(s) where you handle claims.
02Your account#
You are responsible for the security of your account credentials and for all activity under your account. You agree to notify us immediately at support@claim-station.com of any suspected unauthorized access. Sharing accounts is prohibited; each operator must hold their own seat.
03Acceptable use#
You agree not to:
- Use ClaimStation to violate any law, regulation, or third-party right.
- Send spam, unsolicited communications, or content that is harassing, defamatory, or fraudulent.
- Reverse engineer, decompile, or attempt to extract source code from the Service.
- Interfere with or disrupt the Service's infrastructure.
- Use the Service to provide legal advice. ClaimStation is not a law firm and does not provide legal services.
- Use AI-drafted output without your independent professional review. You remain solely responsible for any document, letter, or filing produced through the Service.
04Your data#
You retain all rights in the data you upload or create in ClaimStation ("Customer Data"). You grant us a limited license to process Customer Data solely to provide the Service, as described in our Privacy Policy.
You are responsible for the accuracy, legality, and right to use any Customer Data you upload. If your insureds, contractors, or carriers send communications through your Gmail account that we ingest under your authorization, you represent that you have any consent legally required for that ingestion.
05Carrier emails & third-party services#
ClaimStation does not send email "as ClaimStation" on your behalf to carriers. Outbound carrier communications go through your authenticated Gmail account, preserving the legal chain of custody. You are responsible for the content of every message you send.
Third-party services we integrate (Gmail, DocuSeal, Stripe, iink Payments, Resend, etc.) are governed by their own terms. We are not responsible for the availability or accuracy of third-party services.
06Subscription, fees, and billing#
ClaimStation is offered on a paid subscription basis. Pricing tiers and feature entitlements are described on the public pricing page and in your order form. Billing is processed by Stripe, our payment processor. Fees are billed monthly or annually in advance and are non-refundable except as set out in our Refund & Cancellation Policy, as required by law, or as expressly stated by us.
We may change pricing on prospective renewals with at least 30 days' notice. You may cancel at any time effective at the end of the then-current billing period.
07Disclaimers#
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLAIMSTATION DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL DATA WILL BE PRESERVED.
ClaimStation is a software tool. It does not replace the professional judgment of a licensed public adjuster. Statutory deadline tracking, AI drafting, and document templates are aids, not legal advice, and the operator is solely responsible for verifying the accuracy of every output before relying on it.
08Limitation of liability#
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMSTATION'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. CLAIMSTATION WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA.
09Indemnification#
You agree to indemnify and hold harmless ClaimStation, its affiliates, and personnel from any claim arising out of (a) your Customer Data, (b) your use of the Service in violation of these Terms or applicable law, or (c) your acts or omissions as a public adjuster, including any claim by an insured, carrier, or third party related to your representation.
10Termination#
Either party may terminate the agreement on 30 days' notice for convenience, or immediately for material breach that remains uncured for 14 days after written notice. On termination you may export Customer Data within 30 days; after that we may delete it per our retention schedule.
11Governing law & disputes#
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Brevard County, Florida, and the parties consent to personal jurisdiction and venue there.
12Changes to these Terms#
We may modify these Terms by posting an updated version with a new effective date. Material changes will be notified to operators by email. Continued use of the Service after a change constitutes acceptance.
